GENERAL CONDITION OF SALE

architects-artists-and-artisans.com (hereinafter referred to as “the Website”) is published by the company ARCHITECTS ARTISTS AND ARTISANS LIMITED, company registered in Hongkong under the certificate No.76458760-000-04-24-4(hereinafter referred to as “AAA”). The company’s registered office is in: Flat/RM A 12/F, ZJ300, 300 Lockhart Road, Wan Chai, Hong Kong. The company’s logistic center is situated in: NO.20, Zhijiang Road, Zhijiang Village, Zhouwangmiao Town, 314415 Haining, Jiaxing City, Zhejiang Province, People’s Republic of China.

All orders placed on the Website are subject to these General Terms and Conditions of Sale. AAA reserves the right to adapt or modify these terms at any time, with the version of the General Terms and Conditions of Sale applied to any transaction on the Website at the time of the order.

. Customer

The customer declares to be a natural person, at least eighteen (18) years old, and to have legal capacity or to have parental authorization allowing them to place an order on the Website. When registering the customer’s personal data in the “my account” section, the customer must ensure the accuracy and completeness of the mandatory data provided. In the event of an error in the labeling of the recipient’s coordinates, AAA cannot be held responsible for the impossibility of delivering the product.

. Products

AAA sells items that are the result of artisanal production rather than industrial production, which excludes the completely identical character of the pieces that may vary according to production. The products offered for sale are those described on the Website. AAA takes the utmost care in presenting and describing these products to best satisfy the customer’s information needs. However, it is possible that non-substantial errors may appear on the Website, which the customer acknowledges and accepts. In any case, in terms of non-conformity of the product delivered compared to its description on the Website, the customer may proceed, if necessary, to proceed, in whole or in part, either exchange or refund of the products.

. Order

Any order implies the reading and acceptance of these General Terms and Conditions of Sale in effect on the day of the order. General Terms and Conditions of Sale in effect are those accessible on the Website on the date of the order.

Failure by the customer to fulfill the obligations under these terms, and in particular incidents of non-payment of the price of an order, may result in the suspension of access to the Website, or even the termination of their customer account, depending on the degree of severity of the actions in question, without prejudice to any damages that AAA may seek. Consequently, AAA reserves the right to refuse any order from a customer with whom such a dispute exists. The customer acknowledges the accuracy of the information provided when placing the order, and in the event of an error in the recipient’s contact details, AAA cannot be held responsible for any inability to deliver the product.

In the event of a disagreement, automatic recording systems are considered as evidence of the nature, content, and effective date of the order.

. Delivery-reception

AAA commits to making every effort to execute the order within a period of seven (7) to fourteen (14) working days for delivery. After confirmation of the order and validation of online payment, the package will be delivered to the address chosen by the customer. These delivery times are given for information purposes only, any delays do not entitle the customer to cancel the sale, refuse the goods, or claim damages.

The customer acknowledges that, due to computer errors, it is possible that the goods displayed on the Website may be out of stock in reality. In this case, AAA will contact the customer to offer an exchange, credit note, or refund.

For the delivery, if the customer is absent during delivery, a delivery notice will be left by the carrier in the customer’s mailbox. An electronic message may also be sent to the customer’s email or mobile phone. The customer must contact the carrier to arrange a new delivery appointment.

AAA is released from its delivery obligation for any case of force majeure (total or partial strikes, floods, fires, inability to be supplied, etc.) or unforeseeable circumstances.

. Prices and Payment Methods

1.Price of the products

The prices of the products are indicated in euros with tax included. AAA reserves the right to modify its prices at any time but the products will be invoiced on the basis of the rates in effect at the time of the recording of the order, subject to availability.

2.Transport fee

Delivery from AAA’s logistic center in People’s Republic of China to the customer’s delivery address is free for orders with a total amount of more than three hundred (300) euros. For orders less than three hundred (300) euros, a shipping fee of thirty (30) euros will be added.

3.Customs duty

As soon as AAA receives payment from the customer, it will provide all necessary documents to shipping agent so that it can declare the export and import of goods on behalf of AAA to the customs of the country where the customer resides. The INCOTERM of the delivery will be DAP Shanghai. The customer acknowledges that they will be obliged to pay customs duty to import the goods. This amount will be invoiced by shipping agent before delivery to the customer. AAA will not be responsible for any delivery delays caused by the customer’s failure to pay the customs duty on time.

4.Payment method

The full payment of the order amount and delivery fees is due upon order placement. The products remain the property of AAA until full payment is received.

The customer can choose to pay for their order using a credit card, PayPal, or any other payment method available on the Website. If paying by credit card, the amount of the order will be charged upon validation of the order.

Payment for the order must be made in euros. If the customer pays with a different currency, the exchange rate will be set by the customer’s bank and is not the responsibility of AAA.

The payment process is secured, using high-performance encryption systems and complying with the PCI-DSS security standards.

If the customer’s bank refuses payment authorization, the order will be cancelled.

After payment of the order, the customer will receive an invoice by email. Any claim related to the invoice must be made in writing within fifteen (15) days of receipt of the invoice. Otherwise, the invoice will be deemed accepted without reservation.

AAA reserves the right to refuse any order or delivery in the event of a dispute with the customer, non-payment of a previous order in full or in part by the customer, refusal of credit card payment by banking institutions, or for any other legitimate reason.

VI. Damages during transport and reservations upon delivery

The customer must verify the conformity of the goods upon receipt. In case of loss or physical damage, the customer must immediately report it to the shipping agent to obtain proof of damage during delivery. The customer undertakes to send this proof electronically to AAA before any further request. Otherwise, AAA reserves the right to refuse the customer’s request for exchange or refund.

The customer is required to indicate by email if they wish to proceed with an exchange or refund of the product. Without this information, no claim will be accepted thereafter.

In the event of one or more products that the customer did not order being delivered by mistake, the customer is invited to return the ordered product(s) to the logistic center of AAA.

VII. Exchanges & refunds

The customer benefits from a period of fifteen (15) days during which they can request an exchange or a refund.

To benefit from an exchange, the customer must, within this period, send the products they wish to exchange or return at their own expense to AAA’s logistic center, providing proof of this shipment electronically to contact@architects-artists-and-artisans.com. The returned products must never have been used or damaged, and must be delivered in their original packaging, intact and fit for resale. If any of the above conditions are not met, AAA reserves the right to refuse exchange.

The procedure and the conditions remain the same except that the customer needs to state in the email that they require a redound rather than exchange.

VIII. Responsibility

AAA cannot be held responsible for the non-performance or improper performance of an order in case of force majeure or external causes. The creations and products offered on the Website comply with the current legislation in Hong Kong. AAA shall not be liable for any breach of the legislation of the country where the product is delivered. The choice and purchase of a product are solely the responsibility of the customer. The impossibility to use the purchased product for any reason does not engage AAA’ liability, without prejudice to the provisions of articles VI and VIII of these terms. AAA will not be responsible for the malfunction of the Website and/or the software used on the Website or obtained from it; for the loss of data or services resulting from delays, absence of transmission, incorrect transmission, or interruption of services; for the accuracy, quality or nature of the information obtained through these services, nor for the consequences arising from it, or for any damages resulting from viruses transmitted through these servers; costs, loss of profit, or indirect losses resulting from the use of the Website by the customer, or the inability of the customer to access it.

IX.Information about the customer

The information collected by AAA during a customer’s order is necessary for the management of the transaction. It may, for this purpose, be communicated in whole or in part to service providers of AAA involved in the execution of the order. The customer has the right to access, rectify, oppose and delete the data by addressing to contact@architects-artists-and-artisans.com.
